The CC&Rs for the neighborhood are perceived by some homeowners to contain several topics where homeowners believe certain provisions are overly restrictive, however the Board has the responsibility to uphold the CC&Rs as published. While the Board works to gather homeowner feedback on the CC&Rs for updating, Sunrise Management will inspect the neighborhood for violations as they pertain to property and garden maintenance (in alignment with the rules published in the CC&Rs).
The December winter storm resulted in significant damage to many trees and shrubs. Not only at personal residences but also in HOA common area. The intent of inspections going forward is not to penalize homeowners who are waiting for spring weather to determine if the trees and shrubs have survived or if they will need to be replaced. The HOA is also waiting to see what damage the storm had on common area trees and shrubs.
Starting March 2023, the Board approved and set the following violation fine policy:
1st notice - Letter with deadline
2nd notice - $100 fine
3rd notice - $250 fine
4th notice - $500 fine
CC&R's provide the homeowner with 10 days to rectify the violation. In the event of a significant repair, the homeowner should provide details of the repairs and schedule to Sunrise Management. By doing so this could prevent a follow up violation letter with a fine.
Failure to correct a violation may result in the HOA hiring a vendor to rectify the violation. In this scenario, the cost will be assessed to the homeowner account. Accounts with high balances are at the Board's discretion for filing of a property lien.
